During the practical driving test, the responsibility for infractions committed falls directly on the examinee. Although they do not yet possess a driving license, it is they who are effectively in command of the vehicle and making driving decisions during the test. For this reason, neither the examiner, who merely evaluates the candidate's performance, nor the instructor, who accompanies the test, can be held responsible for the administrative offenses or infractions committed by the examinee during the test.
