When the blood alcohol test shows a positive result, the driver has the right to request a counter-test to confirm or dispute the value obtained. Legislation expressly determines that the choice of method for carrying out this counter-test, whether through a new test with a quantitative analyser (exhaled air) or a blood analysis, rests exclusively with the driver themselves. The supervising authority does not have the power to impose the method to be used for the counter-test, and must respect the option selected by the driver, provided that it is viable and feasible under regulatory conditions.
