During driving instruction, responsibility for contraventions committed generally falls on the instructor. However, this responsibility is transferred to the student if they disobey a prior and express instruction or order given by the instructor, with the latter being responsible for proving that there was disobedience. Responsibility does not always fall on the instructor due to this legal exception of disobedience on the part of the student. Similarly, the owner of the driving school is not directly responsible for traffic infractions committed during practical instruction on public roads.
